**Mining and Minerals Act, 2022**

  * Applies to:
    * Prospecting  
    * Exploration  
    * Mining  
    * Development  
    * Exploitation  
    * Processing, smelting and refining  
    * Trading of mineral substances  
    * Extraction of geothermal resources (s 2)

**Definition of artisanal mining (s 8):**

  * Rudimentary mineral extraction and processing that is:
    * Continuous or seasonal  
    * Conducted by individuals or groups  
    * Based primarily on manual labour and tools  
    * Conducted at single or multiple sites  
    * Producing minerals for:
      * Traders  
      * Local artists and craftsmen  
      * Builders within the domestic economy  

**Artisanal mining operations:**

  * Limited to **10 metres depth**  
  * Must operate under an **artisanal mining licence**
